Cyprus IP Box application — step-by-step ATAD nexus

Applying for Cyprus IP Box is a documentation exercise — the regime is automatic upon meeting requirements, but tax department scrutinizes claims. This guide walks through: (1) confirming qualifying IP (patents, software copyright, utility models — NOT trademarks since BEPS), (2) calculating the nexus ratio (qualifying R&D ÷ total R&D × 1.3 uplift), (3) documenting R&D expenses contemporaneously, (4) filing the income tax return with IP Box claim.

01
Question

What expenses count as qualifying R&D?

Answer

In-house developer salaries, contractor invoices for development work, software licenses used in development, server costs for dev/staging environments, patent registration fees. NOT: marketing, sales, general admin, customer support.

02
Question

How is the nexus ratio calculated?

Answer

Nexus = (qualifying expenditure / total expenditure) × 1.3 (capped at 1.0). Qualifying = in-house R&D + EU outsourced R&D. Non-qualifying = related-party outsourced R&D + acquisition cost of pre-existing IP. The 1.3 uplift compensates for related-party limitations.

03
Question

What if I bought the IP rather than developed it in-house?

Answer

Acquired IP gets reduced benefit — the acquisition cost is non-qualifying expenditure in the nexus calculation. Mixed (acquired + further developed in-house) IP gets partial benefit per the nexus ratio. Pre-2016 grandfathered IP: full benefit through 2021 only.
