Becoming an employer in the UAE

To become an employer in the UAE, a company needs a valid licence, an establishment file with the Ministry of Human Resources and Emiratisation, a written contract for each employee, work permits and residence visas, and salary payment through the Wage Protection System. Records start on the first day.

The legal frame in outline

Employment in the private sector is governed by the Federal Decree-Law on the regulation of labour relations and its executive regulations, enforced by the Ministry of Human Resources and Emiratisation. Free zones such as DIFC and ADGM have their own employment regulations, and your contract must follow the one that applies to your entity.

A written contract is required, and the ministry system registers it. The contract fixes the job title, salary and allowances, working hours, leave and termination terms. Because the law has changed in recent years, a template from an older company or another country is a risk; use a current one reviewed by a local lawyer.

Confirm early whether your company falls under the federal labour law or a free zone's own regulations. The answer affects contract templates, dispute channels and some end-of-service rules, and mixing the two in one template is a frequent error.

Establishment file, permits and visas

Before the first hire, the company opens an establishment file with the ministry, using the trade licence and the tenancy contract. Each employee then needs a work permit and a residence visa, with medical fitness testing and Emirates ID registration. The steps and the typing centres differ slightly between mainland and free zones.

The number of visas a company can sponsor depends on the office size and the licence, so a flexi-desk will limit you. Plan headcount for the next year before choosing the premises, and allow time for each step: a new hire cannot work legally until the permit is in place.

Ask the typing centre or the free zone for a written step list and the expected time per step, and share it with the new hire so they know when they can start and when they may travel.

Paying salaries through WPS

Most private-sector employers pay salaries by the Wage Protection System, which sends salary data to the ministry through a bank or exchange house. The employer must pay on time and the salary file must match the contract. Late payment is monitored, and repeated failures can block new permits.

Payroll calculation and the file itself are handled by your bank, your payroll provider or your accountant. 4softhr.net holds the employee record, leave and timesheets that feed that calculation, but it does not produce WPS files and does not calculate gratuity.

Set a calendar for the payroll cycle too: cut-off date for attendance, review of changes, bank submission and the day salaries must reach accounts. When the cycle is written down, a new colleague can run it during holidays without guessing.

Records worth keeping from day one

Keep one file per employee: signed contract, passport and visa copies, Emirates ID, permit, insurance card, job description, leave history, warnings and the exit paperwork. When the ministry or an auditor asks, you can answer from one place.

Record leave when it is taken, not at year-end. A dispute at the end of the employment relationship is usually about unpaid leave, notice or gratuity, and the side with dated records starts in a stronger position. 4softhr.net records leave and timesheets, and 4mycontracts.net holds the signed contract and amendments.

Add a leaver checklist as well: final settlement calculated by the accountant, visa cancellation, return of equipment, access removed from systems, and a signed clearance form. Employees who leave on good terms are easier to deal with when records are complete.

Take regular backups of the employee files, and restrict access, because they contain passport numbers and salary data that are personal data under the UAE data protection rules.

Mistakes first-time employers make

The most frequent mistake is starting work before the permit is issued. The second is a salary that differs between the contract, the WPS file and the payslip. The third is treating a long-term freelancer as a contractor when the working pattern looks like employment.

Create a short checklist for every hire: contract signed, permit approved, insurance active, salary account set, leave entitlement entered, expiry dates noted. Repeating the list for each person makes the process boring, which is what you want from compliance.

Brief new managers on the basics as well: no work before the permit, no salary outside the contract, no verbal promises about leave. A one-page note read on the first day prevents a surprising number of disputes.

Review your contract template with a lawyer once a year, because labour regulations are amended from time to time and a template that was correct at the start may no longer reflect the current rules on probation, leave or termination.

Probation, notice, gratuity and other duties

Contracts commonly include a probation period, with the maximum set by the labour law, and a notice period on both sides. End-of-service gratuity accrues according to length of service and salary, and the rules for fixed-term and open-ended contracts have changed in recent years, so older templates should not be copied.

Because gratuity is a liability that grows each year, ask your accountant to keep an estimate in the accounts. Keep the salary history and the joining dates in the employee record, since they are the inputs to the calculation.

Larger private employers on the mainland are expected to meet Emiratisation targets set by the ministry, which are updated periodically. Smaller companies may be outside the target but should check the thresholds as headcount grows. Medical insurance, workplace safety and rules on working hours and leave also form part of the duties, so list them in a handbook signed by each new employee.

If your contract template includes a non-compete or confidentiality clause, have a lawyer confirm that its scope and duration are acceptable under UAE law before you rely on it.

Friction

Contracts and employee documents live in different folders.

Fix

Store employment contracts in 4mycontracts and keep the employee record in 4softhr.

02
Friction

Leave balances are tracked in a spreadsheet that nobody trusts.

Fix

Record leave and timesheets in 4softhr. It does not calculate gratuity or submit WPS files.

Friction

A visa or Emirates ID expires unnoticed.

Fix

Note the expiry dates in the employee record and write your own SMS reminders in 4notify.

What must an employment contract in the UAE include?

A written contract normally states the parties, job title, place of work, start date, fixed or open term as the law permits, salary and allowances, working hours and leave. Contracts follow the Federal Decree-Law on labour relations and its regulations. Have a lawyer review your template before you use it with a first employee.

What is the Wage Protection System?

WPS is the electronic system through which most private-sector employers pay salaries via a bank or exchange house, and which the Ministry of Human Resources and Emiratisation monitors. Late or missing salary files can lead to penalties and restrictions on new permits. Your bank or payroll provider submits the file, not 4softhr.

Do I have to provide health insurance?

In Dubai and Abu Dhabi employers are required to provide health insurance for employees, and other emirates have their own rules and phased requirements. Check the requirement of the emirate that issued your licence, because it affects visa issuance, the monthly cost per employee and the cover you must offer from the first hire. وتختلف التغطية المطلوبة بحسب الإمارة والفئة.

Does 4softhr calculate end-of-service gratuity?

No. 4softhr.net keeps employee records, leave and timesheets only. Gratuity is calculated under the labour law from the length of service and salary, so ask your accountant or HR adviser to calculate it, and keep the supporting records and the signed calculation in the employee file for later checks and for the final settlement.
