Exports, customs and zero-rated supplies

What zero-rated means

A zero-rated supply is taxable at 0 %. The supplier charges no VAT to the customer but still counts the sale in its return and can recover input VAT on related costs. This differs from an exempt supply, where no VAT is charged and recovery of input tax is limited.

Zero rating is valuable to exporters because it means that the UAE does not tax the product that leaves the country, while input tax on purchases is returned to the supplier. It depends on proof, and the authority can deny the zero rate if proof is missing.

For that reason, many exporters create an export file for each shipment from the day of the order, instead of trying to rebuild the evidence from emails after the shipment.

Consider a small internal rule: no zero-rated invoice is released until the person issuing it has seen the draft export documents or the signed contract that explains the destination. The rule costs ten minutes per shipment and prevents the most common correction at review time.

Goods: the evidence of export

For goods, the key proof is that they left the UAE, or the implementing states, within the period and by the route the law accepts. The documents usually include the customs export declaration, the commercial invoice, packing list and the transport document.

Where the buyer collects the goods, the file should show that the buyer is a foreign customer and that the goods were taken out of the country, not just collected from a warehouse. Hand-carried exports and sales to tourists follow separate rules, so ask before applying zero rating.

Never alter an invoice after the shipment to match changed quantities. Issue a credit note and a new invoice, so the documents stay consistent.

Keep shipping documents for the same retention period as the invoice itself. Sellers often discard the transport paperwork after a year and then cannot prove the export when the VAT records are examined later.

Services: zero rating for international supplies

Some services supplied to customers outside the UAE can also be zero-rated, for example certain international transport and services to a non-resident customer who is outside the UAE when the service is performed. The conditions are specific and apply to defined categories, not to every service sold abroad.

If you consult for a foreign company, confirm in writing with your adviser whether zero rating applies, and keep the contract, the invoice and the evidence of the customer's location. Many service exporters assume zero rating by default and find out in a review that the conditions were not met.

The description on the invoice should match the contract, and the customer's legal name and country should be clear.

Treat bundled supplies with caution. If a contract combines goods shipped abroad with a service performed in the UAE, the parts may be taxed differently, and the invoice should separate them clearly so that each line carries its own evidence and treatment.

Customs, forwarders and the shipping file

Exports leave through customs offices of the emirate, and a customs code for the company is normally needed. A forwarder or clearing agent files the declaration, but the information comes from your invoice and packing list, so errors in them travel down the chain.

Open a folder for every shipment, named with the invoice number and destination. Add the quotation, the contract, the commercial invoice, the packing list, the transport document, the customs declaration and the payment confirmation. 4invoices.net archives the invoice itself; the other documents are kept in your filing system.

Check shipping terms. The incoterm decides who arranges transport and insurance and at what point risk passes, which affects both the contract and the proof.

Ask your forwarder for a standard document pack and a checklist, and keep the pack for each shipment in the same folder structure so that colleagues can find the file even when the person who handled it is away.

Contracts with overseas customers

Foreign buyers expect a clear contract: description of goods, price, currency, delivery term, payment term, inspection, warranty, governing law and dispute resolution. Drafting these in a consistent template reduces negotiation time and errors.

4mycontracts.net lets you draft, route for approval and sign sales agreements electronically, so you can close deals with customers in different time zones without printing and scanning. For significant markets, ask a local lawyer to review mandatory local rules such as agency and consumer laws.

Choose the governing law and the forum thoughtfully. Many UAE exporters use English law or the DIFC and ADGM courts or arbitration for cross-border contracts.

Mistakes that lose the zero rate

Common errors include shipping without the right documents, invoicing the wrong entity, issuing an invoice before the export is confirmed and accepting payment from an unrelated third party without documentation.

Another is applying zero rating to a sale delivered inside the UAE to a foreign buyer's local agent. The test is where the goods go, not who pays.

Review a sample of export invoices every quarter. For each, ask: can I show the goods left, and does the file say so? Fixing a gap quickly is easier than defending it a year later.

A short internal audit of five export invoices per quarter, each traced from invoice to customs declaration to payment, is enough to find the weak points in your process early.

Name one person in the company who is responsible for export files, and one deputy. When shipments are frequent, a clear owner prevents the situation where every invoice is correct but nobody knows where the matching customs papers are.

Are all exports from the UAE zero-rated?

Exports of goods outside the implementing GCC states can be zero-rated if conditions are met, and some exported services qualify too. The conditions include proof of export and the correct documents. A sale that looks like an export but lacks evidence may be taxed at 5 %, so check each type of sale with your adviser.

What evidence supports a zero-rated export?

Typically the commercial invoice, the customs export declaration, the transport document such as the bill of lading or airway bill, and proof of payment. Some cases need additional documents. Keep them together under one shipment reference and for the full retention period of the VAT records. Keep the originals of any documents the customs authority stamped.

Does a free zone change anything for exports?

It can. Some free zones are treated as designated zones for VAT, and goods moving in or out of them follow special rules. Customs procedures also vary between zones and emirates. Ask your forwarder and adviser to confirm how your zone and your goods are treated before shipping. Check your own situation with a specialist.

Does 4invoices handle customs declarations?

No. 4invoices.net produces PDF invoices with your TRN and keeps an invoice archive. Customs declarations are filed through the customs authority systems, usually by a clearing agent on your behalf. The ecosystem does not connect to customs systems or to the Federal Tax Authority, so keep the declaration copies with the shipment file yourself. ولا يغني ذلك عن مراجعة مخلّصك الجمركي.
