Remote teams and freelancers across cities and countries

Employees and freelancers are different relationships in Indian law, and treating a freelancer like an employee, or the reverse, creates risk. Keep employee records and leave in 4softhr, freelancer agreements in 4mycontracts and tasks in 4myprojects. Classification itself is a legal question to settle with your adviser.

Employee or freelancer: why it matters

An employee works under the employer's control, on the employer's schedule, usually full time and for a salary. A freelancer runs their own business, chooses how to deliver, works for several clients and invoices for results. The difference determines whether you owe provident fund contributions, leave, gratuity, notice periods and Shops and Establishments protections, or only the contract price.

There is no single test, and courts look at the reality of the relationship rather than the label. A person called a consultant who works fixed hours at your office under your supervision for years may be treated as an employee. Take advice before you classify long-term arrangements.

A practical test is to ask five questions. Does the person work only for you? Do you set their hours? Do you provide their tools? Do you direct how the work is done? Would you pay them if the project paused? Four or five yes answers point to an employment relationship, however the contract is labelled.

Consider an agency that engages a designer as a consultant for three years at a monthly fee, with a fixed schedule at the agency's office and no other clients. When the designer leaves, a claim for notice pay or gratuity-type benefits becomes possible, because the actual relationship looks like employment. Reclassifying early, with a proper appointment letter, costs less than defending the label later.

Records that keep the two groups apart

Keep two lists. Employees go into 4softhr with joining date, department, attendance and leave. Freelancers appear as vendors with an agreement in 4mycontracts, an invoice trail and tasks in 4myprojects. Never put a contractor in the attendance register to make them easy to schedule; that blurs the line you are trying to maintain.

Review the lists once a quarter. Anyone who has quietly become full time, with a set schedule and no other clients, should be considered for an employment contract.

Onboarding differs too. An employee receives an appointment letter, a policy handbook and access to staff systems. A freelancer receives a statement of work, a confidentiality undertaking and access limited to the project, which you remove when the engagement ends.

The freelancer agreement

A good freelancer agreement states the deliverables, the fee and payment dates, a requirement to issue a GST invoice where the freelancer is registered, confidentiality, and the assignment of intellectual property to your business. Under Indian copyright law an assignment must be in writing, so a freelancer's work does not become yours merely because you paid for it.

Add who bears the freelancer's tools and taxes, how many revisions are included, and either side's right to end the engagement with notice. Payments to professionals can attract tax deducted at source, so ask your accountant what applies to each type of freelancer before the first payment.

Insist on the freelancer's own tax particulars. Ask for their PAN and, if they are registered, their GSTIN and a proper invoice. A freelancer below the GST threshold issues an invoice without tax, and you should file it with the payment record.

Working across states and borders

A remote employee living in another state can bring that state's rules into play, for example professional tax, labour welfare contributions or Shops and Establishments registration. An employee who works from abroad may trigger obligations in that country, including tax and social security, and may create a taxable presence for your company there.

Do not allow remote arrangements to start informally. Decide the work location, record it in the employee's record, check the rules with your adviser and put the conditions in the employment letter.

Equipment and data security matter more when people work from home. Decide who owns the laptop, which accounts the person may use, how files are backed up and what happens to company data when the relationship ends. Write these rules into the employment letter or the freelancer agreement.

Running the work day to day

Remote teams need written rhythm: tasks with owners and due dates in 4myprojects, a short weekly status, and a shared calendar for leave. In 4softhr, record leave requests and approvals for employees so that balances are clear. Freelancers send invoices on delivery of milestones instead of timesheets.

Use the output, not presence, as the measure for freelancers and agree core overlap hours for employees across time zones. Written expectations avoid the common disappointment of two people with different assumptions about when a message should be answered.

A weekly ten-minute review on the project board keeps remote work visible: what moved, what is blocked and what is due next. Asynchronous status messages written by each person before the call make the meeting shorter.

Measure what matters: tasks completed against tasks planned each week, hours between a client question and a reply, and the number of items waiting on someone outside the team. Three numbers on the board tell a manager more about a remote team than a daily check of who is online.

Payroll and statutory duties stay outside

4softhr records employees, attendance, shifts and leave. It does not calculate Indian salaries, provident fund, ESI, professional tax or TDS, and payroll calculation in the product exists for Romania only. Your accountant or payroll provider runs payroll, using attendance and leave data from the register as input.

The same is true for freelancer payments: the app keeps the agreement and the invoice trail, while the tax treatment of each payment is for your accountant to determine.

When a freelancer is converted to an employee, close the old agreement, record the new joining date and have a fresh employment letter signed, so that the records show a clean transition.

How do I know if someone is an employee or a freelancer?

Courts look at the reality of the relationship: control over how and when the work is done, exclusivity, fixed hours, integration into the business and who bears the tools and risk. A label in the contract is not decisive. For long-term arrangements, ask your lawyer or adviser to assess the classification. Record the reasons for your classification in the file, so that the decision can be explained later.

Do I need a written agreement with a freelancer?

Yes. It should set deliverables, fees, confidentiality and, crucially, assign intellectual property to you in writing, since Indian copyright law requires a written assignment. Without it, the freelancer may remain the owner of the work you paid for. Store signed agreements where finance and legal can find them. Keep the signed copy beside the invoices, which proves the terms under which each payment was made.

Can remote employees work from another Indian state?

Often yes, but the state of work can bring its own rules on professional tax, Shops and Establishments registration or welfare contributions. Check with your adviser before approving relocation and record the work location in the employee's record. Cross-border remote work needs separate advice. Ask for the work location in writing and update it in the employee record whenever it changes.

Does 4softhr run payroll for remote staff in India?

No. 4softhr keeps employee records, attendance, shifts and leave. It does not calculate Indian salaries, provident fund, ESI, professional tax or TDS; payroll calculation exists for Romania only. Your accountant or payroll provider handles those duties using the attendance and leave data you maintain. Record leave and attendance in the register so the accountant can run salaries without chasing managers.
